O Conselho Federal da Ordem dos Advogados do Brasil (OAB) ajuizou, nesta segunda-feira (25), Ação Direta de Inconstitucionalidade (ADI 4927), com pedido de liminar, questionando dispositivos da Lei 9.250/1995 (com a redação dada pela Lei 12.469/2011) que estabelecem limites de dedução no Imposto de Renda da Pessoa Física (IRPF) de despesas com instrução do contribuinte e seus dependentes. Segundo a OAB, a imposição de limites reduzidos de dedutibilidade ofende comandos constitucionais relativos ao conceito de renda, capacidade contributiva, da dignidade humana, da razoabilidade e o direito à educação.
A OAB questiona os itens 7, 8 e 9 do inciso II do artigo 8º da lei que fixaram os limites de dedução para os anos-base de 2012, 2013 e 2014. Segundo a entidade, o teto de dedução para despesas com educação é irrealista. De acordo com a lei, para o ano-base de 2012, o limite é de R$ 3.091,35, subindo para R$ 3.230,46 em 2013 e atingindo R$ 3.375,83 a partir do ano-base de 2014.
A OAB argumenta que, embora não esteja defendendo a existência de uma vedação constitucional à fixação de um limite razoável para dedução, “tampouco há um dever constitucional de limitar-se a dedutibilidade dos gastos com educação na base de cálculo do IRPF, restrição aliás inexistente para as despesas com saúde e pensão alimentícia”.
De acordo com a entidade, o objetivo da ADI não é discutir se seria aceitável, em tese, a imposição de um limite de dedução de gastos com educação, desde que condizente com a realidade. Segundo os autos, até que nova lei venha a ser editada, o teto para dedução desses gastos deixaria de existir, tal como ocorre para outras despesas com saúde e pensão alimentícia.
“O que apenas se afirma é que [o limite] é inconstitucional, nos termos em que ora fixado. A procedência desta Ação Direta, obviamente, não levará o STF a definir o teto de abatimento que entenda legítimo. Isso é tarefa a ser empreendida pelo legislador, sempre sujeito ao controle judicial”, sustenta a OAB.
A OAB defende que a eliminação do teto de dedução para despesas com educação não prejudicaria a coerência interna do tributo. De acordo com a ação, a dedutibilidade das despesas com instrução da base de cálculo do IRPF não é favor fiscal sujeito ao arbítrio do legislador, mas consequência direta dos comandos constitucionais referentes ao conceito de renda, da capacidade contributiva, da dignidade humana, do não confisco e o direito à educação.
Em razão da data limite para entrega da declaração de ajuste do IRPF – 30 de abril -, a OAB pede a suspensão imediata dos dispositivos da lei, por decisão monocrática do ministro-relator, a ser posteriormente submetida a referendo pelo Plenário, ou a pronta inclusão do processo em pauta, antes mesmo de serem ouvidos a Presidência da República e o Congresso Nacional e da manifestação da Advocacia-Geral da União (AGU) e da Procuradoria-Geral da República (PGR).
A OAB defende que a concessão da cautelar antes do prazo final para a entrega da declaração permitirá que os contribuintes façam a dedução total das despesas com educação na elaboração de suas declarações de rendimentos e imporá à Receita Federal do Brasil que a considere de ofício ao processar as declarações recebidas antes da decisão do STF, “tudo de forma a evitar desembolsos indevidos pelos particulares e a minorar a necessidade de devolução de valores indevidamente arrecadados pela União”.
